1. Acceptance of Terms

By accessing or using KinkMatch.app ("KinkMatch", "Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility & Age Requirement

KinkMatch is a consumer service intended for personal, non-commercial use only. We do not offer business accounts, VAT ID validation, or reverse charge invoicing.

The Service is intended for adults only. You must be at least 18 years old (or the legal age of adulthood in your jurisdiction, if higher) to use KinkMatch. By using the Service, you confirm that you meet this requirement.

3. What KinkMatch Is (and Isn't)

KinkMatch is an adult card-swiping game designed to help individuals and couples discover intimacy preferences in a consent-first, entertainment context. KinkMatch does not provide medical, psychological, or professional relationship advice. You are solely responsible for your own actions and for ensuring consent, safety, and legality in your relationships.

4. Accounts, Free Version & KinkMatch+

Free version: The free version stores game data locally on your device using your browser's local storage. We do not receive this local game data from your device. The Service enforces an automatic deletion of this local game data after 24 hours by clearing the local data on your device when the 24-hour period is reached (measured from your first use of the Service on your device).

Note: Local storage behavior can vary depending on your device/browser settings (e.g., private mode, clearing site data). If you want persistent access across devices, KinkMatch+ is required.

KinkMatch+: KinkMatch+ is a paid subscription that provides features such as cloud-based profile storage and additional functionality ("KinkMatch+ Features"). Availability and exact features are shown at checkout and/or inside the product UI. We may add, modify, or remove features over time. If a change would materially reduce paid core functionality for existing subscribers, we will provide notice where reasonably possible and offer an appropriate remedy (for example, allowing cancellation).

5. Subscriptions, Billing & Merchant of Record

KinkMatch+ is a paid subscription. Pricing, billing cycle, and the features included are displayed at the time of purchase. All prices are final.

Payments are processed by PayPal (PayPal Europe S.à r.l. et Cie, S.C.A., Luxembourg). Receipt/invoice details and payment terms are shown during checkout and on your receipt. We generate an invoice for each payment, sent to your account email.

You can cancel at any time. Cancellation takes effect at the end of the current billing period. Unless required by mandatory law or expressly stated at checkout, we do not provide refunds for partial billing periods.

6. Right of Withdrawal (EU Consumers)

If you are a consumer in the European Union, you generally have a statutory right to withdraw from distance contracts within 14 days.

Important — digital services/content exception: Where KinkMatch+ Features are provided immediately after purchase, your right of withdrawal may expire once performance begins, provided you have given (1) your prior express consent to immediate performance and (2) your acknowledgement that you thereby lose your right of withdrawal. This consent/acknowledgement is obtained during checkout where applicable.

If you wish to exercise a withdrawal right before performance begins (where available), email hey@kinkmatch.app with your name, the email used at checkout, your subscription date, and an unequivocal statement that you withdraw from the contract. If a refund is due, it will be processed within the statutory period.

7. Acceptable Use & User Conduct

You agree to use KinkMatch responsibly and respectfully. You must not:

• use the Service for illegal purposes;
• attempt to access, probe, reverse engineer, disrupt, or interfere with the Service or any related systems;
• attempt to access other users' data or accounts;
• upload, transmit, or distribute malware or abusive content through the Service;
• use automated means (including scraping) to access, extract, or copy the card database or other content;
• circumvent or attempt to circumvent access restrictions, feature limitations, or subscription enforcement mechanisms.

The Service is designed for consensual exploration between adults. Always obtain clear consent. Stop immediately if consent is withdrawn.

8. Privacy & Data

We process personal data as described in our Privacy Policy. We do not sell your personal data. For details on what is stored locally vs. in the cloud (KinkMatch+), retention periods, and security measures, see the Privacy Policy.

9. Intellectual Property & License

All content, design, card database, trademarks, and functionality of KinkMatch are owned by wasmitAI® (or its licensors) and are protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.

Sharing: You may share screenshots of your personal results (e.g., KinkProfile, KinkScore, KinkMatch Wrapped) and individual KinkCards for personal, non-commercial, or social sharing. If "KinkMatch" is not already visible, you must credit "KinkMatch" in the post or caption. You may not share any couple or match results that include another person's preferences without that person's explicit consent. KinkCards and game content may depict adult themes — you are solely responsible for ensuring your shared content complies with the rules of any third-party platform (in particular social media, messenger services, or other public or private platforms).

10. Availability, Changes & Termination

We may update, modify, suspend, or discontinue parts of the Service at any time for operational, security, legal, or product reasons. We do not guarantee uninterrupted availability.

Changes to Terms: We may update these Terms from time to time. For KinkMatch+ subscribers, we will provide advance notice of material changes by email or in-product notice where reasonably possible. In urgent cases (e.g., security, legal compliance), changes may take effect sooner. You may object or cancel your subscription if you do not agree with material changes. For free users, updated Terms apply upon publication on this website. The current version is always available at KinkMatch.app.

Termination: We may suspend or terminate your access if you violate these Terms, create risk for other users, or if required for legal or security reasons. You may stop using the Service at any time.

11. Liability

KinkMatch is provided for entertainment and personal exploration purposes. We accept unlimited liability for intent and gross negligence, and for injury to life, body or health. In cases of slight negligence, we are liable only for the breach of essential contractual obligations (cardinal duties), limited to foreseeable, typical damages. Mandatory statutory liability (including under product liability law, where applicable) remains unaffected.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer residing in the EU, you retain the protection of mandatory provisions of your country of residence.

If you are a merchant (Kaufmann), a legal entity under public law, or a special fund under public law, the place of jurisdiction is Berlin, Germany.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

Who We Are

Our Privacy Promise

KinkMatch is built with privacy-by-design. We aim to collect as little personal data as possible and keep sensitive game content private.

What We Don't Do

• We do not sell your personal data.
• We do not share your personal data with advertisers.
• We do not track you across other websites for advertising.
• We do not require your real name.
• We do not use automated decision-making that produces legal or similarly significant effects.

Data We Process

Free Users (local-only gameplay): Your game data (swipes, preferences, results) is stored locally on your device using your browser's local storage (localStorage). We do not receive this local game data from your device.

24-hour deletion (Free Users): The Service enforces an automatic deletion of local game data after 24 hours (measured from your first use of the Service on your device) by clearing the local data on your device when the 24-hour period is reached.

KinkMatch+ Subscribers: If you subscribe, we process account data needed to provide the service (typically email address and authentication data). Game data may be stored in the cloud so you can access it across devices.

Note: Cloud data may be processed by our hosting/infrastructure providers in the EU/EEA and, where applicable, in other countries as described under "International Transfers".

Payment Data: Payments are handled by PayPal (PayPal Europe S.à r.l. et Cie, S.C.A., Luxembourg), which processes payment-related personal data (e.g., billing details, transaction data) as an independent controller under its own Privacy Statement. We receive your PayPal email address, payer ID, and transaction details to manage your subscription. We do not store your full payment details (e.g., full card numbers).

Basic technical data: Like most websites, our infrastructure providers may process technical data necessary to deliver and secure the Service (e.g., IP address, device/browser information, timestamps, requested pages), primarily for security, abuse prevention, and performance.

We do not store this technical data ourselves; where our providers process it for security and stability purposes, it is retained only as long as necessary for those purposes or as required by law, and then deleted or anonymized.

Support communications: If you contact us (e.g., by email), we process the information you provide (such as your email address and message content) to respond and provide support. Please avoid sending highly sensitive personal details unless necessary.

Why We Process Your Data

• Service operation (Free Users): We process local storage data because it is necessary to provide the game on your device.
• Age confirmation: KinkMatch deals with adult themes but shows no pornographic depictions or nudity. Before you start, you confirm you are at least 18. We remember that confirmation so we don't have to ask you on every visit.
• KinkMatch+ account & cloud features: We process account and cloud data because it is necessary to deliver the subscription features you sign up for.
• Analytics: To improve the Service, we collect anonymous usage statistics (e.g., pages viewed, device type, country, game progress) using our own first-party analytics. We do not set tracking cookies and we do not store IP addresses. To distinguish visits, we use a pseudonymous, daily-rotating identifier that cannot be traced back to a person and is not linked to your account. Individual preferences are not stored; analysis is carried out solely as aggregate totals. Raw event data is deleted after no more than 90 days; anonymous aggregate statistics may be kept indefinitely. The legal basis is our legitimate interest (Art. 6(1)(f) GDPR).
• Security & abuse prevention: We process technical and security-related data because we have a legitimate interest in protecting the Service, preventing abuse, and maintaining availability.
• Support communications: We process your messages because it is necessary to respond to your inquiry and provide support.

Cookies & Local Storage

KinkMatch does not use advertising or tracking cookies. We use local storage on your device for gameplay data and the age confirmation.

Cloudflare may use technically necessary cookies or similar mechanisms for security (e.g., bot protection). These mechanisms are used to deliver the website securely and are not used for advertising tracking.

Third Parties

• Cloudflare: Security, performance, and analytics infrastructure.
• Ionos: Website hosting and server infrastructure (Germany, EU).
• PayPal: Payment processing and subscription billing (PayPal Europe S.à r.l. et Cie, S.C.A., Luxembourg). PayPal handles payment-related personal data under its own Privacy Statement.

International Transfers

Some providers may process technical data in countries outside the EU/EEA (including the United States). Where required, transfers are protected by appropriate safeguards such as EU Standard Contractual Clauses and, where applicable, additional measures.

Data Deletion & Retention

Free users: Local game data is automatically deleted after 24 hours (measured from your first use of the Service on your device). You can also delete it earlier at any time by clearing site data/local storage in your browser settings.

KinkMatch+ Subscribers: You can delete your data from your profile settings (where available). Upon account deletion, remaining cloud data is deleted within 30 days unless a longer retention is required by law (for example, for invoices/records).

Sensitive data (KinkMatch+): The profile data you store in the cloud (in particular your game results, plus a self-chosen display name and details about gender and preferences) can reveal your sexual preferences and is therefore a special category of personal data (Art. 9 GDPR). The legal basis is your explicit consent (Art. 9(2)(a) GDPR), which you give when you purchase KinkMatch+. The data is stored encrypted and used solely to provide permanent storage and cross-device access; we do not access it for any other purpose and do not share it. You can withdraw your consent at any time by deleting your cloud data or your account.

Support communications: We keep support emails only as long as necessary to respond and for documentation of support, unless a longer retention is required by law.

Your Rights

You may have rights regarding your personal data, including the right to access, correct, delete, restrict processing, export your data, and object to certain processing. To exercise your rights, contact hey@kinkmatch.app. We typically respond within 30 days.

You also have the right to lodge a complaint with a supervisory authority. In Berlin: Berliner Beauftragte für Datenschutz und Informationsfreiheit — datenschutz-berlin.de.

Security

We use HTTPS for data transmission. We implement appropriate technical and organizational measures to protect account and cloud data. No method of transmission or storage is 100% secure.
