Orientations & Identities – What does divers (gender marker) mean?
Divers (Gender Marker)
Divers is Germany’s third official gender entry besides female and male, introduced in 2018, which people can choose in the civil register if neither binary option fits them.
What does Divers mean?
Divers is German for diverse. It’s the third gender entry in Germany’s civil register, next to “weiblich” (female) and “männlich” (male). It was introduced in December 2018 after the Federal Constitutional Court ruled in 2017 that intersex people need a positive option, not just a blank field. Since 2013, the entry could already be left empty, and that option still exists. In passports, both divers and no entry show up as “X”.
Who can choose divers?
At first, only intersex people with a medical certificate could. Since the Self-Determination Act came into force in November 2024, anyone whose gender identity doesn’t match their entry can change it by declaration at the registry office, with no certificate needed. That means non-binary, genderqueer and agender people can also choose divers or have the entry removed. The change must be registered 3 months in advance, and another change is possible after 1 year at the earliest.
How do you address someone with the divers marker?
Ask, don’t guess. Many people with a divers entry prefer not to be called Mr or Ms and use neutral pronouns or simply their name. In letters and forms, a neutral greeting like “Hello Alex Schmidt” works well. In English, the title Mx. is a common choice.
